Legal disclaimer

The work is provided under the terms of this Creative Commons Public License (“CCPL” or “Liecense”). The work is protected by copyright and/or other applicable law. Any use of the work other than as authorized under this license or copyright law is prohibited.

By exercising any rights to the work provided here, you accept and agree to be bound by the terms of this license. The licensor grants you the rights contained here in consideration of your acceptance of such terms and conditions.

1. Definiciones

  1. "Work" means the literary, artistic, or scientific creation offered under the terms of this License.
  2. "Author" means the individual or entity that created the work.
  3. A "Joint Work" is one that may be included in one of the following categories:
    1. "Work of Collaboration", understood to be the joint result of collaboration between various authors.
    2. "Collective Work", meaning a work that has been created on the initiative and under the coordination of a legal entity or individual who publishes and divulges said work under his or her name, and which is constituted by the combination of personal contributions from different authors which come together to form a single autonomous creation, conceived for this purpose, without it being possible to separately attribute rights to any of them over the collective whole of the work produced.
    3. "Independent Composite Work", understood as a new work that incorporates an already existing work without collaboration from the author of the latter.
  4. "Derivative Work" means a work based upon the work, or upon the work and other pre-existing works, such as: translations and adaptations; revisions, updates and annotations; compendia, summaries and extracts; musical arrangements and, in general, any transformations of a literary, artistic or scientific work, unless the resulting work has the nature of a joint work, in which case it will not be considered as a derivative work for the purpose of this License. For the avoidance of doubt, where the work is a musical composition or sound recording, the synchronization of the work in timed relation with a moving image ("synching") will be considered a derivative work for the purpose of this License.
  5. "Audiovisual Works" will be considered to be creations expressed through a series of associated images, with or without an incorporated soundtrack, as well as musical compositions which are essentially designed to be shown via projection systems or any other means for the public communication of image and sound, regardless of the nature of the material format of such works.
  6. "Licensor" means the individual or entity that offers the work under the terms of this License and grants exploitation rights to said work in accordance with the stipulations of the License.
  7. "Transformation" of a work takes in its translation, adaptation and any other modification to its form from which a different work derives. Where a data base is concerned, as defined below, any reordering of the same will also be considered to be transformation. The creation resulting from the transformation of a work will be considered to be a derivative work.
  8. "Reproduction" is understood to be the placing of the work within a medium that makes it possible for the work to be communicated and for copies of all or part of it to be obtained.
  9. "Distribution" is understood to be the making available to the public of the original or of copies of the work through sale, hiring, loan or any other means.
  10. "Public communication" will be understood to be any act whereby a plurality of individuals may have access to the work without prior distribution of copies to each of them. Communication will not be considered to be public when it occurs within a strictly domestic sphere without incorporation or connection to any kind of distribution network. For the purposes of this License, public communication will be taken to be making the work available to the public through corded or cordless procedures, including when the work is made available to the public in such a way that anyone may have access to it wherever or whenever they so choose.
  11. "Exploitation" of the work comprises its reproduction, distribution, public communication and transformation.
  12. "Data bases" will be considered to be collections of the works of others, of information and of other independent elements such as anthologies and data bases in the strict sense of the term which, due to the selection or arrangement of their contents, constitute intellectual creations, regardless of rights, should they exist, that might still apply to such contents.
  13. "Elements of the license" are the main characteristics of the license as they have been selected by the Licensor  and indicated in the title of this License: Attribution of Authorship (Attribution), with No Commercial Use (Non-Commercial), with No Derivative Works (WithoutDerivativeWorks).

2. Fair Use Rights. Nothing in this license is intended to reduce or restrict any legal rights on the exclusive rights of the copyright owner arising from fair use, first sale or other limitations under copyright law or other applicable laws, whether they derive from legitimate uses, such as the right to a private copy or the right to quote, or from other limitations such as that deriving from the first sale of copies.

3. License Grant. Subject to the terms and conditions of this License, the Licensor hereby grants You (for the duration of the applicable copyright) a worldwide, royalty-free, non-exclusive, perpetual License, which includes the granting of the following rights:

  1. The Right to the reproduction, distribution and public communication of the Work;
  2. The Right to incorporate it within one or more joint works or data bases and to its reproduction when incorporated within such joint works or data bases;
  3. The right to the distribution and public communication of copies or recordings of the work when incorporated within joint works or data bases;

The above rights may be exercised in all media and formats, either tangible or intangible, or now known or hereafter devised. The above rights include the right to make such modifications as are technically necessary to exercise the rights in other media and formats. All rights not expressly granted by the Licensor are hereby reserved, without limitation, including the rights established in 4d.

4. Restrictions. The granting of rights embodied in this license is subject to and limited by the following restrictions:

  1. You may reproduce, distribute or publicly communicate the work only under the terms of this License and must include a copy of it, or of its Uniform Resource Identifier (URI), with every copy or recording of the work that You reproduce, distribute or publicly communicate. You may not offer or impose any terms on the work that alter or restrict the terms of this License or the recipients’ exercise of the rights granted hereunder. You may not sublicense the work. You must keep intact all notices that refer to this License and to the disclaimer of warranties. You may not reproduce, distribute or publicly communicate the work with technological measures that control access or use of the work in a manner inconsistent with the terms of this License. The above applies to the work as incorporated in a joint work or data base, but does not mean that the latter, apart from the work that is the object of this License, have to be subject to the terms of this License. If You create a joint work or data base, upon notice from the Licensor You must, to the extent practicable, remove from the joint work or data base any credit as required in clause 4b, as requested. If You create a derivative work, upon notice from the Licensor You must, to the extent practicable, remove from the derivative work any credit as required by clause 4b, as requested.
  2. If You reproduce, distribute or publicly communicate the work or any derivative work, joint work or data base that incorporates it, You must keep intact all copyright notices for the work and provide, reasonable to the medium or means You are utilizing, the name (or pseudonym, if applicable) of the original author, if supplied, and/or, if the original author and/or Licensor designate other parties (for example: an institution, publication, journal) for attribution in the copyright notice, conditions of use or by other reasonable means; the title of the work if supplied; to the extent reasonably practicable, the Uniform Resource Identifier (URI), if any, that the Licensor specifies to be associated with the work, unless such URI does not refer to the copyright notice or licensing information for the work; and, in the case of a derivative work, a credit identifying the use of the work in the derivative work (e.g., "Spanish translation of the work by Original Author," or "screenplay based on original work by Original Author"). Such credit may be implemented in any reasonable manner; provided, however, that in the case of a derivative work, joint work or data base, at a minimum such credit will appear where any other comparable authorship credit appears and in a manner at least as prominent as such other comparable authorship credit.
  3. For the avoidance of doubt, without prejudice to the preceptive authorization of the Licensor, in particular when the work is of an audiovisual nature, the Licensor waives the exclusive right to  receive, both individually and via a royalties management body, or via a number of the same (for example, SGAE, Dama, VEGAP), rights from exploitation of the work, as well as those stemming from derivative works, joint works or data bases, if such exploitation principally seeks, or is directed towards, obtaining commercial benefit or private monetary remuneration.
  4. Should the work be included in any data base or compilation, the data base owner or manager must waive any right associated with this inclusion and concerning uses of the work once it has been extracted from the data bases, whether individually or jointly with other materials.

5. Representations, Warranties and Disclaimer

UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES, THE LICENSOR OFFERS THE WORK AS-IS AND MAKES NO WARRANTIES OF ANY KIND CONCERNING THE WORK, OR THE PRESENCE OR ABSENCE OF ERRORS THAT MAY OR MAY NOT BE DISCOVERED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF SUCH WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU.

6. Limitation on Liability

UNLESS EXPRESSLY AND IMPERATIVELY STIPULATED BY APPLICABLE LAW, IN NO EVENT WILL THE LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY GENERAL OR SPECIAL (INCLUDING GENERAL DAMAGE AND LOSS OF PROFIT), INCIDENTAL OR CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Termination

  1. This License and the rights granted hereunder will terminate automatically upon any breach by You of the terms of this License. Individuals or entities who have received joint works or data bases from You under this License, however, will not have their licenses terminated provided such individuals or entities remain in full compliance with this License. Sections 1, 2, 5, 6, 7, and 8 will survive any termination of this License.
  2. Subject to the above terms and conditions, the License granted here is perpetual (for the duration of the applicable copyright in the work). Notwithstanding the above, the Licensor reserves the right to release or publish the work under different license terms or to withdraw the work at any time. Nonetheless, this will not mean that this License (or any other license that has been, or is required to be granted, under the terms of this License) is to be concluded, and it will continue in full force and effect unless terminated as stated above.

8. Miscellaneous

  1. Each time You exploit the work, or joint work or data base in which it is incorporated, the original Licensor offers to third parties and successive Licensees a License to the work on the same terms and conditions as the License granted to You under this License.
  2. Each time You distribute or publicly digitally perform a derivative work, the Licensor offers to the recipient a License to the original work on the same terms and conditions as the License granted to You under this License.
  3. If any provision of this License is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this License and, without further action by any of the parties to this agreement, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.
  4. This License constitutes the entire agreement between the parties with respect to the work licensed here. There are no understandings, agreements or terms with respect to the work that are not expressly specified in this License. The Licensor shall not be bound by any additional provisions that may appear in any communication from You. This License may not be modified without the mutual written agreement of the Licensor and You.

Creative Commons is not a party to this License, and makes no warranty whatsoever in connection with the work. Creative Commons will not be liable to You or any party on any legal theory for any damages whatsoever, including without limitation any general, or special (including general damage and loss of profit), incidental, or consequential damages arising in connection with this License. Notwithstanding the foregoing two (2) sentences, if Creative Commons has expressly identified itself as the Licensor hereunder, it shall have all rights and obligations of Licensor.

Except for the limited purpose of indicating to the public that the work is licensed under the CCPL, neither party will use the trademark "Creative Commons" or any related trademark or logo of “Creative Commons” without the prior written consent of Creative Commons. Any permitted use will be in compliance with Creative Commons' then-current trademark usage guidelines, as may be published on its website or otherwise made available upon request.
